Reproductive rights are internationally recognized as critical both to advancing women's human rights and to promoting development.  Governments from all over the world have, in recent years, both acknowledged and pledged to advance reproductive rights to an unprecedented degree.  But for governments, non-governmental organizations (NGOs), and concerned advocates to work towards reforming laws and policies so as to implement the mandates of these international conferences, they must be informed about the current state of national level formal laws and policies affective reproductive rights.    This book on Latin America and the Caribbean is the product of a unique series of collaborative reports between the U.S.-based Center for Reproductive Law and Policy and national-level NGOs around the world.    CRLP and NGOs in have surveyed laws and policies in Argentina, Bolivia, Brazil, Colombia, El Salvador, Guatemala, Jamaica, Mexico, and Peru with respect to the following issues:  * Laws and policies regarding contraception, abortion, sterilization, and HIV/AIDS and other sexually-transmitted diseases;  * Women's status as it relates to:  marriage (including common law unions and cohabitation), property rights, labor rights, credit, education, and the right to physical integrity;  * Reproductive health and rights of adolescents, including segments on marriage, sex education, and sexual offenses against minors.

The Chilean abortion law prohibits all abortions and is one of the most restrictive in the world. Chilean women are being prosecuted for obtaining or inducing their own abortions and are, in some cases, being sent to prison. This analysis documents a pattern of human rights abuses against these women. The New York-based Center for Reproductive Law and Policy and the Open Forum on Reproductive Health and Rights in Santiago (Foro Abierto) assert that the restrictive abortion law violates women's reproductive rights, including their right to health, their right to liberty and security, as well as potentially their right to life. In addition to the rights violated by the prohibition itself, the methods by which women are reported to the police and the criminal process that women, the abortion providers and their "accomplices" undergo, violate numerous other human rights. This book makes recommendations to the Chilean government to undertake a series of legal and policy changes, such as ensuring improved access to reproductive health services and instituting an exception for therapeutic abortion.

En noviembre de 1999 se celebraron elecciones presidenciales en Guatemala. El nuevo gobierno, dirigido por el presidente Alfonso Portillo, debería tener como prioridad la promulgación de un marco legislativo y una política adecuados que garanticen el derecho de sus ciudadanos y ciudadanas a la información y los servicios de planificación familiar.     Toda mujer tiene el derecho de controlar el número de hijos, el lapso entre ellos y el momento de su nacimiento. Sin embargo, si no existen posibilidades de acceso a información y servicios de planificación familiar, este derecho no tiene ningún sentido. El hecho de que el gobierno guatemalteco no haga posible a sus ciudadanos y ciudadanas el ejercicio de su derecho a una gama completa de servicios de salud reproductiva, incluidos los servicios y la información sobre planificación familiar, tiene repercusiones trágicas en la salud y la vida de las mujeres. Su capacidad para participar plenamente en la vida económica, política y social de su país se ve gravemente constreñida cuando no tienen ningún medio de control de su fertilidad y deben enfrentarse a un embarazo no deseado.
