Patent Law and Practice

This text was originally commissioned by the Federal Judicial Center as an introduction to patent law for U.S. federal judges, but is now available to the wider public. Proceedings in the federal courts and the patent and trademark office are covered in opening chapters. Other chapters cover patentability, claim construction, infringement, equitable defenses, remedies, and jury trials. The material has been brought up to date to 2002, covering the Supreme Court's decision in Festo Corp. v. Shoketsu Kinzoku Kogyo Kabushiki , which dealt with prosecution-history estoppel.
