Regulatory Takings and Proposals for Change

The 5th Amendment to the Constitution prohibits the gov't. from taking private property for public use without paying the owner just compensation. Some owners allege that the gov't's. regulations have effectively taken their property -- by restructuring the ways in which they can use it -- and that they should be compensated.
