Wildlife Law: Law Commission Report #362

Description:
In this report the Law Commission makes recommendations to replace the patchwork of existing legislation with a single statute. The new statute brings together the law governing the protection, control and management of wildlife to make it more consistent, easier to understand and simpler to use. Reflecting relevant EU directives and international conventions as well as national wildlife policy, the statute provides a regulatory framework organized around schedules listing protected and controlled species and prohibited conduct. The structure of this Report follows as closely as possible the structure of the Wildlife Bill, so as to make it easy to read alongside the draft clauses of the Bill: Prohibited conduct: core international and EU obligations; Prohibited conduct: protection of wild birds; Prohibited conduct: protection of wild animals; Prohibited conduct: protection of wild plants; Permitted activity: licensing and defences; Poaching: substantive prohibitions; Control of non-native species, pests and weeds; Criminal liability, enforcement and sanctions.
