The study of criminal justice has suffered from a lack of cohesion. It has been the stepchild of the sociology of law and of deviance, especially criminology, but has only rarely been approached as an area of investigation in its own right. Encumbered by narrow legal interpretations, police science orientations (often nothing more than "war stories" and technological suggestions), and reforming zeal, sociologists have found it difficult to treat criminal justice in the same way they approach the study of the traditional areas of inquiry. This book is a step toward treating criminal justice like any other phenomenon of sociological interest, and we claim no special privileges or exemptions because the subject matter we deal with is criminal justice. To this end we have organized the subject matter into various components, compared empirical studies and methodologies, and presented various theoretical frameworks. After having read the book, the student, we hope, will be familiar with some of the basic issues in criminal justice, will understand the day-to-day processes that constitute criminal justice in operation, and will be able to interpret several different criminal justice situations. In short, we hope that the student will be able to understand criminal justice in the same way sociologists understand any other social process. We have chosen studies of the criminal justice process based on their relevance to key issues. Some of these issues are substantive, such as the studies of police discretion; others are theoretical, dealing with frameworks for understanding various procedures and activities. Each, we believe, is interesting, and many could be called controversial. Our task, however, is not to condemn or justify the criminal justice process but to encourage students of introductory criminal justice and sociology to think about this massive and complex process and perhaps pursue their inquiry further.
