On December 10, 1790, the Georgia General Assembly created Elbert County, from a portion of Wilkes County, making Elberton the seat of its new government. The Inferior Court, made up of five justices of the peace for the county, tried any civil case except those involving title to land. The Inferior Court had jurisdiction over county business matters, such as care for the poor, building and maintaining the courthouse and jail, building and maintaining roads and bridges, establishing ferries, issuing licenses to sell liquor, appointing guardians, nominating justices of the peace and constables, authorizing indentures, and maintaining a register of wills. The Clerk of the Inferior Court kept minutes of its various proceedings. The first volume of Inferior Court Minutes begins February 4, 1791 and continues through July 14, 1801. The following transcription comes from the microfilm of the original record book made in 1960 for the Genealogical Society of Salt Lake City, Utah and the Georgia Department of Archives and History.

The county's Inferior Court, made up of five justices of the peace for the county, tried any civil case except those involving title to land. The Inferior Court had jurisdiction over county business matters, such as care for the poor, building and maintaining the courthouse and jails, building and maintaining roads and bridges, issuing liquor licenses, nominating justices of the peace, performing naturalizations, appointing guardians, authorizing indentures, and maintaining a register of wills. The Clerk of the Inferior Court kept minutes of the foregoing proceedings--every one of which places individuals in Jefferson County at a particular point in time--and those minutes comprise the basis for this book. Volume VII of Inferior Court Minute transcriptions is based on the original Minute Books 10, 11, and 12 and carries the series forward from October 26, 1835, through May 20, 1868. Volume VII is the concluding volume in this series, and it is, by far, the largest one. It also encompasses the tumultuous years of the antebellum period and U.S. Civil War.

On December 10, 1790, the Georgia General Assembly created Elbert County, from a portion of Wilkes County, making Elberton the seat of its new government. In 1777, Georgia's first constitution established the Superior Court of final jurisdiction in each county. The legislature divided the state into judicial districts, fixing the times the various courts met in each county, assigning the new Elbert County to the Western District, comprised of Franklin, Green, Hancock, Jackson, Lincoln, Oglethorpe, and Wilkes counties. The judges, elected to serve three-year terms, held court in each county at least twice per year, as they traveled from county to county within their district. The Superior Court had jurisdiction over all criminal matters, civil cases involving title to land, appeals from Inferior Court decisions, divorces, grand juries, and registration of land deeds. The first volume of Superior Court Minutes begins December 31, 1790 and continues through October 16, 1800. The following transcription comes from the microfilm photographed at the courthouse at Elberton in 1960, by the Genealogical Society of Salt Lake City, Utah, and available at the Georgia Department of Archives and History in Morrow, Georgia and the Family History Library.

The records include the orders appointing road commissioners and overseers, petitions to construct new roads and bridges or alter existing ones, and the reports of commissioners regarding the efficacy and public utility of newly proposed roadsand bridges or alterations or repairs to existing ones.
