Not illustrated. 1823 Excerpt: ... and may be lawful for the justice of the peace before whom he shall be taken, or to whom any such complaint shall be made, to commit him to the house of correction for any time not exceeding three months, or to proceed against him for the penalty aforesaid, by a description of his person and the offence only, without adding any name or designation, but expressing in the proceedings that he refused to discover his name." 3 G. 4. By stat. 3 G. 4. c. 126. § 140. after reciting that whereas offences may be committed against this act, or other acts for repairing and maintaining turnpike roads, by persons unknown to the collectors or other officers, it is enacted, "that it shall be lawful for any of the trustees or commissioners of any turnpike road, or their clerk or clerks, or their collectors, surveyors, or other officers respectively, and such other person or persons as he or they shall call to his or their assistance, without any warrant or other authority than this act, to seize and detain any unknown person or persons who shall commit any such offence or offences, and take him, her, or them before any justice of the peace for the county, district, or place near to the place where the offence or offences shall be committed, or such offender or offenders shall be seized and apprehended; and such justice and justices shall, and is and are hereby required to proceed and act with respect to such offender or offenders, according to the provisions of this or any other acts for repairing turnpike roads."
